Welcome to JetSki Miami, operated by Gonchar Group LLC. By accessing our website at jet-ski-miami.com, booking our services, or communicating with us through any channel (Instagram, Telegram, email, phone, or in person), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Services

JetSki Miami provides jet ski rental experiences in the waters of Miami Beach, Florida. Our services include:

• Guided and self-guided jet ski rentals (30-minute, 1-hour, and 2-hour sessions)
• Safety briefings and equipment orientation
• Online and in-person booking
• Customer support via Instagram Direct Messages, Telegram, email, and phone

2. Eligibility

• You must be at least 18 years old to rent and operate a jet ski
• Riders aged 14–17 may ride only with a supervising adult on board, in accordance with Florida law
• A valid government-issued photo ID is required at check-in
• A Florida Boater Safety Education ID Card is required by Florida law for all operators born on or after January 1, 1988. If you do not have one, you may obtain a temporary certificate through our affiliate partner BoatTests101 (approximately $13.95, takes about 30 minutes)

3. Booking and Payment

• A $100 deposit via Zelle is required to secure your booking
• The remaining balance is due upon arrival and may be paid by cash or card
• Current pricing ranges from $149 to $349 depending on duration and package selected
• Prices are subject to change without prior notice; the price confirmed at the time of booking will be honored
• All prices are in US Dollars and include basic equipment (life jacket, safety lanyard)

4. Cancellation and Refund Policy

• 24+ hours before scheduled ride: Full refund of deposit
• 12–24 hours before: 50% of deposit retained
• Less than 12 hours or no-show: Deposit is non-refundable
• Weather cancellation by JetSki Miami: Full refund or free reschedule at your choice
• Refunds are processed within 5–7 business days to the original payment method

5. Safety Requirements and Liability Waiver

Safety is our top priority. Before operating any jet ski, all participants must:

• Sign a liability waiver and rental agreement (collected digitally through WaiverForever)
• Attend a mandatory safety briefing and equipment orientation
• Wear a U.S. Coast Guard-approved life jacket at all times while on the water
• Follow all instructions provided by JetSki Miami staff
• Comply with all applicable federal, state, and local boating laws and regulations

By signing the waiver and participating in our rental, you acknowledge and accept the inherent risks of personal watercraft operation, including but not limited to drowning, injury from collision, marine life encounters, and equipment malfunction.

6. Damage and Security Deposit

• You are responsible for any damage to the jet ski caused by negligence, reckless operation, or violation of safety rules during your rental period
• JetSki Miami carries liability and hull insurance coverage; however, the renter may be held responsible for costs arising from willful misconduct or gross negligence
• Any damage must be reported to staff immediately upon return

7. Prohibited Conduct

While operating our jet skis, you must NOT:

• Operate under the influence of alcohol, drugs, or any impairing substance
• Exceed designated operating areas or speed zones
• Allow unauthorized persons to operate the jet ski
• Perform dangerous maneuvers, stunts, or operate recklessly
• Remove or tamper with any safety or GPS tracking equipment
• Tow any person, tube, or object behind the jet ski

Violation of these rules will result in immediate termination of your rental without refund and may result in additional liability.

8. GPS Tracking and Monitoring

All jet skis are equipped with GPS tracking devices for safety and security purposes. By renting from us, you consent to the monitoring of the jet ski's location during your rental period. This data is used solely for safety, geofencing enforcement, and recovery in case of emergency or theft.

9. Automated Messaging and AI Assistants

By contacting us via Instagram Direct Messages, Telegram, or other digital channels, you consent to receiving automated responses from our AI-powered booking assistant. The assistant can help with booking inquiries, pricing, availability, and general questions. You may request to speak with a human representative at any time by asking for a "live agent."

10. Intellectual Property

All content on the JetSki Miami website — including text, images, logos, videos, and design elements — is the property of Gonchar Group LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

11. Limitation of Liability

To the maximum extent permitted by law, Gonchar Group LLC, its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to personal injury, property damage, or loss of enjoyment. Our total liability for any claim shall not exceed the amount you paid for the rental giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Gonchar Group LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorney's fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.

13. Governing Law and Disputes

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

14. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the revised terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
